Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all users of the Omva platform. It sets out what you may and may not do when using Omva to create and operate insurance comparison sites. Breaches of this AUP may result in suspension or termination of your account.

1. Permitted Uses

You may use the Omva platform to:

  • Create and operate branded insurance comparison and referral websites
  • Market your site through lawful advertising and content marketing
  • Refer new users to the Omva platform under the Referral Programme
  • Customise your site's appearance and content within the platform's tools
  • Invite team members to collaborate on your account (within your plan's seat limits)

2. Prohibited Content

You must not publish or display content that:

  • Is false, misleading, or deceptive about any insurance product, insurer, or Omva
  • Constitutes regulated financial advice under the Financial Markets Conduct Act 2013
  • Infringes the intellectual property rights of any person or organisation
  • Is defamatory, discriminatory, harassing, or threatening
  • Contains or promotes illegal activity
  • Impersonates any insurer, Omva, regulator, or other person
  • Contains sexually explicit, violent, or otherwise offensive material

3. Prohibited Technical Activities

You must not:

  • Attempt to reverse-engineer, decompile, or extract the source code of the platform
  • Use automated tools to scrape, crawl, or harvest data from the platform
  • Conduct or facilitate denial-of-service attacks or other security attacks
  • Upload malicious code, viruses, or any software designed to cause harm
  • Attempt to access accounts, data, or systems you are not authorised to access
  • Circumvent any security, rate-limiting, or access-control feature of the platform
  • Resell, sublicence, or white-label platform access without written consent from Omva

4. Data & Privacy

You must:

  • Handle any personal data collected through your site in compliance with the NZ Privacy Act 2020
  • Maintain a current and accurate privacy policy on your site if you collect visitor data
  • Not collect more personal data from visitors than is necessary for the stated purpose
  • Not sell or share visitor data with third parties without explicit consent

5. Referral Conduct

You must:

  • Make clear to visitors that your site refers them to insurance providers and does not constitute financial advice or a recommendation to purchase any specific product
  • Not represent yourself as an insurance adviser, broker, or agent unless you independently hold the relevant licence outside of Omva
  • Comply with the Fair Trading Act 1986 in all marketing and customer communications
  • Not make promises about insurance outcomes, premiums, or coverage on behalf of any insurer

6. Reporting Violations

If you become aware of a violation of this AUP by another user, please report it to abuse@omva.co.nz. We investigate all reports and take appropriate action.

7. Consequences of Breach

Depending on the severity and frequency of a breach, Omva may: issue a warning, suspend your account, terminate your account, or refer the matter to appropriate authorities. We reserve the right to remove any content that violates this AUP without notice.

8. Changes to This Policy

We may update this AUP from time to time. We will notify you by email of material changes at least 14 days before they take effect.
